RESOLUTION NO. XXVI.253.2015

ZIELONA GÓRA CITY COUNCIL

from December 21, 2015

regarding the statute of the Archaeological Museum of the Middle Oder in Zielona Góra with its seat in Świdnica

    On the basis of art. 18 sec. 2 item 15 and art. 40 sec. 2 item 2 of the Act of 8 March 1990 on local government (Journal of Laws of 2015, item 1515, consolidated text), art. 6 sec. 1 and 2 of 21 November 1996 on museums (Journal of Laws of 2012, item 987, consolidated text, as amended 1 ), after consultation with the Minister of Culture and National Heritage, the following is granted:

STATUTE OF THE ARCHAEOLOGICAL MUSEUM OF THE MIDDLE ODRA RIVER

IN ZIELONA GÓRA WITH THE HEADQUARTERS IN ŚWIDNICA

Chapter 1.

Name, area of ​​operation and seat of the museum

§ 1. The Archaeological Museum of the Middle Oder in Zielona Góra, based in Świdnica, hereinafter referred to as “MAŚN”, is a local government cultural institution with legal personality.

§ 2. The organizer of MAŚN is the City of Zielona Góra, hereinafter referred to as the “organizer,” which provides MAŚN with the resources needed for its maintenance and development.
§ 2.1. MAŚN is entered in the Register of Cultural Institutions maintained by the organizer under number 5.
§ 2.2. MAŚN is entered in the State Register of Museums maintained by the minister responsible for culture and national heritage under number 20/PRM/98.

§ 3.  The seat of MAŚN is Świdnica in the Lubusz Voivodeship, and the area of ​​operation is the territory of the Republic of Poland.

§ 4.  MAŚN may use a round seal with the image of an eagle established as the coat of arms of the Republic of Poland and the name of the Museum on the rim: Archaeological Museum of the Central Oder Region in Zielona Góra with its seat in Świdnica.

§ 5.  Whenever the resolution mentions:

1) statute – this shall be understood as this statute;
2) city – this shall be understood as the City of Zielona Góra;
3) president – ​​this shall be understood as the President of the City of Zielona Góra;
4) director – this shall be understood as the director of MAŚN;
5) act – this shall be understood as the Act on Museums.

Chapter 2.

Scope of activity and the type and scope of the collected collections

§ 6.  MAŚN conducts activities aimed at protecting cultural property in the field of archaeology.
§ 6.1. The scope of MAŚN’s activities includes collecting, storing, preserving, and making available property in the field of archaeology and history.

§ 7.  MAŚN collects:

1) archaeological monuments from the ancient, medieval and modern periods, obtained from own research and deposits;
2) historical monuments related to the history of the Lubusz Land;
3) archaeological documentation and materials from research conducted in the Lubusz Voivodeship by other entities.

§ 8.  MAŚN conducts the activities referred to in § 6, in particular through:

1) collecting cultural goods and documentary materials in the field of archaeology;
2) replenishing the collections through purchases, allocations, donations, bequests and accepting deposits;
3) inventorying, cataloguing and scientifically processing the collected museum objects and documentary materials;
4) storing the collected museum objects in conditions ensuring their complete safety and storing them in a manner accessible for scientific purposes;
5) securing and preserving museum objects;
6) organizing and conducting scientific research;
7) organizing permanent, temporary and traveling exhibitions;
8) conducting educational and teaching activities in the field of art;
9) making the collections available for scientific and educational purposes;
10) publishing catalogues, exhibition guides, research results and popular science publications within the scope of its activities and the organization of exhibitions;
11) maintaining a library in the field of museology and auxiliary disciplines, and
12) making it available to research workers, students and teachers.

§ 9.  MAŚN may undertake other activities to meet the social needs of the region and

implementation of the principles of cultural policy.

Chapter 3.

The management and supervisory body and advisory bodies and the method of appointing them

§ 10. General supervision over the MAŚN is exercised by the minister responsible for culture and national heritage.
§ 10.1. Direct supervision over the MAŚN is exercised by the president.

§ 11 . MAŚN is managed by a director, who is appointed and dismissed by the president in accordance with the principles and procedures set out in applicable regulations.  
§ 11.1 . The president is the director’s official superior.


§ 12. The Director manages all MAŚN activities and is responsible for the proper management of MAŚN’s property and financial resources.
§ 12.1. The responsibilities of the MAŚN Director include, in particular:

1) representing the Museum of the History of Polish Art in external matters;
2) general management of basic and administrative activities;
3) general supervision of the collections and their recording;
4) presenting material and financial plans, reports, and investment proposals to the organizer and the relevant institutions;
5) creating organizational and technical conditions for planning and implementing
defense tasks 6) specified in separate regulations;
7) creating conditions for improving the professional qualifications of employees;
8) supervising the chief editorial office of museum publications;
9) directly managing the research staff;
10) setting the amount and fees for admission to the Museum of the History of Polish Art and the day on which admission is free;
11) submitting applications for changes, disposals, and deletions of museum objects from the inventory;
12) issuing internal regulations and instructions;
13) performing the employer’s function in relation to the employees of the Museum of the History of Polish Art;
14) organizing internal control and supervising its functioning;

§ 13.  The detailed internal organization of MAŚN is determined by the organizational regulations issued by the director, subject to the provisions on organizing and conducting cultural activities.

§ 14.  The Museum Council operates at MAŚN.
§ 14.2. The Museum Council consists of 5 members.
§ 14.3. Members of the Museum Council are appointed by the Zielona Góra City Council.
§ 14.4. The Museum Council operates within the scope and under the principles specified in Article 11 of the Act on Museums.

Chapter 4.

Sources of financing for MAŚN activities

§ 15. MAŚN manages its finances in accordance with the principles set forth in the regulations on organizing and conducting cultural activities.
§ 15.1. The basis for MAŚN’s financial management is the financial plan established by the director, while retaining the organizer’s subsidy. § 15.2
. MAŚN’s assets may be used only for purposes arising from the scope of MAŚN’s activities.
§ 15.3. The Director ensures the timely preparation of the annual financial report.

§ 16.  The sources of financing for MAŚN are:

1) entity-specific and targeted subsidies from the state budget or local government unit, including funds provided by the organizer in the form of subsidies:

  • for financing current activities within the scope of statutory tasks carried out, including the maintenance and renovation of facilities;
  • earmarked for financing or co-financing the costs of investment implementation;
  • earmarked for the implementation of the indicated tasks and programs.

2) income from business activities;

3) funds received from natural and legal persons and other sources;
4) income from the rental and lease of assets.

§ 16.1. MAŚN allocates its revenues to cover the costs of its statutory activities.

§ 17. MAŚN may conduct, as an additional activity, business activities in the
provision of archaeological and commercial services.
§ 17.1. Income from business activities is allocated to financing the statutory activities of MAŚN.


§ 18. The director is authorized to make declarations on behalf of MAŚN regarding its financial and property rights and obligations.
§ 18.1. The director may appoint proxies to perform specific legal acts on behalf of MAŚN, specifying the scope of the power of attorney. § 18.2.
The granting and revocation of a power of attorney is subject to disclosure in the Register of Cultural Institutions maintained by the organizer, with the exception of powers of attorney for legal proceedings.     

Chapter 5.

Final provisions, rules for making changes to the statutes

§ 19.  Any changes to this statute may be made in accordance with the procedure established for its adoption.

§ 20.  Resolution No. XV/127/2000 of the Zielona Góra County Council of 8 November 2000 on granting a statute to the Archaeological Museum of the Middle Oder in Zielona Góra with its seat in Świdnica shall cease to apply.

§ 21.  The execution of this resolution is entrusted to the Mayor of Zielona Góra.

§ 22.  The resolution shall come into effect 14 days after its publication in the Official Journal of the Lubuskie Voivodeship.
